Berg v Canadian Hockey League

Shantona Chaudhury and Cristina Senese argued on behalf of the Law Foundation of Ontario in the appeal to the Divisional Court.


The class action, brought by former OHL players against their respective teams and leagues for the failure to observe minimum statutory employment standards, was certified against the Canadian team defendants but not against the American team defendants. The LFO, which had provided financial support to the plaintiffs from the Class Proceedings Fund and was therefore obliged to pay the defendants’ costs from the Fund, sought leave to appeal the costs awarded to the American team defendants.
